The Securities and Exchange Commission (SEC) said the companies, including Interactive Brokers Corp, Fifth Third Securities and Nuveen Securities, agreed to pay a total of $79 million and admitted they violated the record keeping rules. Credit rating agencies DBRS Inc. and Kroll Bond Rating Agency, LLC also agreed to pay civil penalties to settle SEC charges related to the record-keeping failures, the regulator added. Employees at both firms failed to preserve electronic communications, including off-channel messages on personal and work-issued devices, the SEC said. To settle the charges, DBRS agreed to pay $8 million in civil penalties and KBRA agreed to pay $4 million in civil penalties, the SEC said.

Idalia to boost Florida apartment insurance costs further

Costs have risen the most on multifamily properties such as apartments and condos, according to industry executives and data from credit ratings agency Moody's. Property insurance costs to multifamily assets in Florida have gone up anywhere from 30% to 70% in the past year, and are even higher for those with prior losses, non-renewing insurance carriers or valuation issues, she said. Nationally, CRE properties' insurance costs have grown roughly 7.6% annually on average since 2017, according to an August Moody's report. RENTS, CAP RATESRising insurance premiums on multifamily properties have contributed, among other factors, to rent increases in Florida and elsewhere, said three industry executives. Insurance costs are also forcing CRE lenders to boost due diligence on refinancing and when pricing deals on apartment blocks, executives said.

NEW YORK, Aug 14 (Reuters) - Basswood Capital, Adage Capital Partners and Paul Tudor Jones' Tudor Investment Corp were among the hedge funds that took new positions in real estate investment trusts that specialize in New York City office space last quarter, despite questions over how long work-from-home policies will weigh on the market, securities filings released on Monday showed. Basswood Capital purchased roughly 360,000 shares of Vornado Realty Trust and nearly 72,000 shares of SL Green, while Adage Capital Partners bought 205,000 shares of SL Green. Tudor Investment Corp bought nearly 152,000 shares of SL Green. Shares of Vornado are up nearly 7% for the year to date, while shares of SL Green are up slightly less than 1%. Basswood, Adage Capital, and Tudor Investment Corp did not respond to requests for comment.

The rise in the rate reflects continued stress in the U.S. commercial real estate sector as a post-pandemic environment had more people working from home or shopping online. Office loans made up roughly 35% of the newly special serviced and delinquent loans in July rated by KBRA at $898.4 million. So far in July, multiple office properties have been transferred to special servicing due to imminent monetary default. The total special servicing balance on multi-loan CMBS sharply increased $830.7 million to $14 billion, the largest rise since August 2020, the report said. KeyBank's subsidiary KeyBank Real Estate Capital handles commercial real estate lending and servicing.

Still, previously unreported data from New York-based real estate data provider Trepp, shared with Reuters, show many regional banks' holdings exceed thresholds stipulated by regulators. While big banks have recently warned about CRE exposure, the new Trepp data underscores how acute and widespread the problem is across the banking sector. The regulatory guidance requires that banks exceeding these thresholds "should employ heightened risk management practices," including potential sales of specific loans. Meanwhile, New York Community Bancorp (NYCB.N) and Flagstar Bank [RIC:RIC:FBCANK.UL] were among the top five banks listed by Trepp that exceeded the CRE loan threshold. In Tuesday congressional testimony, FDIC chair Martin Gruenberg warned CRE loan portfolios "face challenges" should market conditions persist.

Analyst Kashy Harrison downgraded shares to neutral from overweight, saying the U.S. residential solar power market could undergo a reset this year on weaker demand. GoodLeap is a provider of financing options for the residential solar energy industry that holds about 30% market share, according to the note. Enphase Energy shares are down 17% this year.
